Tree Surgeons Tufnellpark Terms and Conditions

Tree surgeons carrying out safe pruning work on a residential treeThese Terms and Conditions set out the basis on which Tree Surgeons Tufnellpark provides arboricultural services to residential, commercial and other customers in the UK. By making a booking, accepting a quotation, or allowing work to begin, the customer agrees to be bound by these terms. They are intended to create a clear and fair framework for the provision of tree surgery services, including surveys, pruning, crown reduction, felling, stump works, emergency call-outs and associated site clearance.

In these terms, references to “we”, “us” and “our” mean the tree surgery business providing the service, and references to “you” and “your” mean the customer or person placing the booking. These conditions apply alongside any written quotation, job specification or scope of works. If any part of those documents conflicts with these terms, the more specific written document will usually take priority for that particular item, unless otherwise agreed in writing.

We reserve the right to update these terms from time to time. The version in force at the time your booking is confirmed will normally apply to your contract. If any change is required by law or affects how services are delivered, we may apply the updated wording immediately where permitted. If you do not accept a material change, you should notify us before the work starts.

1. Booking Process

Crew assessing a tree surgery site and planning access for worksA booking with tree surgeons in Tufnellpark usually begins with an enquiry and, where appropriate, an initial discussion about the condition of the tree, the access available, the nature of the site and the type of work requested. Any estimate or quotation provided before a site visit is based on the information available at that time and may change if the actual conditions differ from what was described.

Where required, we may carry out a site inspection to assess the tree, surrounding structures, utilities, access routes, ground conditions and any likely constraints. You agree to provide accurate information and to point out any known issues, including subsidence concerns, service lines, parking restrictions, protected trees, tree preservation orders, conservation controls or shared boundaries. Failure to provide complete information may result in revised pricing, altered scheduling or cancellation of the works.

Once a quotation is accepted, a provisional date or time window may be offered. A booking is only confirmed when we have acknowledged acceptance, or when a deposit or other agreed payment has been received. We may need to reschedule due to weather, staffing, equipment availability, legal restrictions or other operational reasons. Tree surgery services are highly dependent on safe working conditions, and we may postpone work if conditions are unsuitable.

Branch removal and waste handling during professional tree surgeryIt is your responsibility to ensure that the site is accessible on the agreed date. This includes parking arrangements where possible, clear access to the working area, the removal or secure control of pets and any necessary permissions from neighbours, landlords, managing agents or freeholders. If our team arrives and cannot proceed because of access issues or missing permissions, we may charge a reasonable cancellation or abortive visit fee.

Where emergency tree works are requested, the booking process may be accelerated. In urgent situations, we may have to prioritise safety, temporary risk reduction and the securing of dangerous material before returning for follow-up work. Any verbal instruction given in an emergency should still be confirmed in writing where practical. The customer accepts that emergency attendance is often based on rapid decision-making and may involve additional costs.

If the customer requests changes after confirmation, we will try to accommodate them, but any changes may affect pricing, equipment requirements, staffing, timing and disposal arrangements. Significant changes, such as adding additional trees, increasing the scope of pruning, or requesting extra stump grinding, may require a revised quotation and a new scheduled date.

2. Prices and Payment

All prices are quoted in pounds sterling unless otherwise stated. Quotations may be fixed-price or estimated, depending on the information available and the complexity of the work. If the scope changes, if hidden conditions are discovered, or if access proves more difficult than expected, the final charge may be adjusted reasonably to reflect the additional labour, time, equipment or disposal requirements. Tree surgeons Tufnellpark will always aim to explain any change before additional costs are incurred where this is practicable.

Unless a different arrangement is agreed in writing, invoices are due for payment on completion of the work, or within the period stated on the invoice. Deposits may be required to secure larger jobs, specialist equipment, traffic management, or works involving multiple visits. We may refuse to start or continue work where an agreed deposit has not been paid in full.

Late payments may be subject to interest and recovery costs where permitted by law. If payment is overdue, we may suspend further services, withhold final paperwork or certificate-style documentation where applicable, and pursue recovery through lawful means. Any discounts, promotional rates or price reductions are offered at our discretion and may be withdrawn if the customer breaches these terms or if the job specification changes.

3. Cancellation and Rescheduling

Customers may cancel or reschedule a booking by giving notice as soon as possible. Because tree surgery teams, machinery and waste logistics are often arranged in advance, short-notice cancellation may result in charges. Unless otherwise agreed, cancellations made with less than 48 hours’ notice may incur a reasonable fee to cover planning, reserved time and any non-refundable third-party costs. Repeated short-notice changes may also affect our ability to offer future dates.

If we need to cancel or reschedule, we will aim to provide as much notice as possible. Circumstances may include unsafe weather, high winds, frozen ground, heavy rainfall, equipment failure, staff illness, transport disruption, unforeseen site hazards or legal restrictions affecting the work. In such cases, we will try to agree an alternative date. We are not liable for indirect loss arising from a necessary reschedule, provided we act reasonably.

Where a tree is found to pose an immediate danger, we may need to alter the planned scope of works to make the site safe. This may include temporary measures rather than the originally requested full service. In that event, the customer may be asked to approve the revised approach before work continues. If approval cannot be obtained and safety requires us to stop, we may charge for the portion already completed.

Arborist securing a work zone before tree maintenance beginsIf you wish to cancel a booking after materials, hire equipment, disposal arrangements or specialist permits have been arranged, you may still be charged for those committed costs. Customers are encouraged to review their quotation carefully before confirming. No charge will usually be made where cancellation is due solely to our failure to attend without reasonable cause, though this does not affect rights that cannot be excluded under law.

4. Liability and Customer Responsibilities

We will carry out all tree surgery services with reasonable skill and care, using competent staff and appropriate equipment. However, tree work carries inherent risks, especially where trees are diseased, structurally compromised, subject to hidden decay, or located near buildings, walls, glass, vehicles, overhead lines or underground services. The customer acknowledges that even properly performed arboricultural work may involve unavoidable residual risk.

To the fullest extent permitted by law, we are not responsible for pre-existing defects, latent structural problems, hidden defects in trees, naturally occurring failure, or damage caused by circumstances outside our reasonable control. We are also not liable for losses that are indirect or consequential, such as loss of profit or business interruption, except where such exclusion is prohibited by law. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded.

You agree to tell us about known hazards before work begins, including buried services, fragile structures, boundary disputes, asbestos, unstable ground, contaminated land, or any other condition that could affect safe operations. You must also ensure that children, pets, visitors and unauthorised persons are kept away from the work area. Where we recommend that an area be closed off or that access be restricted, you should follow that advice.

We may take reasonable steps to protect the site, but we are not responsible for pre-existing damage to lawns, driveways, fences, planting, paving or underground features where access by heavy machinery or timber extraction is necessary and has been discussed or is reasonably required by the nature of the work. After completion, some disturbance to ground surfaces, bark, sawdust or minor debris may remain, especially in wet weather or on soft ground. Unless a specific clean-up standard has been agreed, our obligation is to leave the site in a generally tidy condition consistent with the work carried out.

The customer is responsible for obtaining any consents, permissions or licences required for the works unless we have expressly agreed in writing to arrange them. This may include permission from property owners, managing agents, local authorities or utility providers. If work is delayed or prevented because permissions were not secured, we may charge for any time spent attending site or preparing for the job.

Any advice we give regarding tree health, future maintenance or general management is provided in good faith based on the information available at the time. Trees are living organisms and their condition can change unpredictably. Unless a written guarantee is expressly stated, our comments should not be interpreted as a warranty that a tree will remain stable, disease-free or free from future decline.

5. Waste, Timber and Environmental Regulations

Finished tree surgery site with cleared waste and tidy surroundingsTree surgery work often produces green waste, timber, brash, sawdust, woodchip and stump arisings. Where we include waste removal, disposal will be carried out in accordance with applicable UK waste rules and environmental obligations. We aim to reuse, recycle or recover as much organic material as is practical, subject to the condition of the material and the facilities available. Waste may be transferred only to licensed or otherwise authorised sites or carriers as required by law.

Unless stated otherwise, the quotation will specify whether waste is to be removed from site or left for the customer to manage. If waste is left on site at your request, you accept responsibility for its storage, lawful use and subsequent disposal. We will not be responsible for any nuisance, staining, pest attraction or council enforcement action arising after waste has been handed over or left with the customer.

If the work reveals diseased timber, invasive species, protected nesting activity or other environmentally sensitive material, we may need to handle it differently from standard green waste. In such circumstances, we may stop, adapt or postpone the work in order to comply with legal and environmental duties. We may also need to separate certain materials for appropriate disposal or specialist treatment, which can affect price and scheduling.

6. Site Conditions, Safety and Access

We expect the site to be reasonably safe and accessible on the agreed date. If the ground becomes waterlogged, icy or otherwise unsafe, we may defer the job. We may also stop work if we identify electrical hazards, unstable structures, aggressive animals, unexpected traffic risks, or any other condition that could place our team or others at risk. Safety decisions made by our supervisor on site are final for the purpose of that visit.

Our operatives may use ladders, ropes, climbing systems, elevated platforms, chainsaws, chippers and stump grinders. You must not interfere with tools, machinery or the work zone. If you or your representatives choose to remain present during the work, you must keep a safe distance and follow all reasonable instructions given by our team. We may refuse to continue if our directions are not respected.

Where a tree is adjacent to a highway, footpath, public space or neighbouring land, additional precautions may be required. These could include barriers, signage, traffic management or temporary exclusion zones. Any such measures may be chargeable where they are necessary to complete the work lawfully and safely. A customer should not assume that all control measures are included unless specifically listed in the quotation.

7. Complaints, Disputes and Governing Law

If you believe there is a problem with the service, you should raise it promptly so that we can investigate. We may ask for photographs, a description of the issue and an opportunity to inspect the relevant area. We prefer to resolve concerns informally and reasonably. If any part of the service falls short of what was agreed, our aim is to assess the issue and, where appropriate, put it right in a fair and proportionate way.

These terms are governed by the laws of England and Wales. Any dispute arising from or connected with the services, the quotation, the booking or these terms will be dealt with by the courts of England and Wales, unless mandatory law provides otherwise. If any clause is found to be invalid or unenforceable, the remaining clauses will continue in force.

The headings in these terms are for convenience only and do not affect interpretation. Failure by us to enforce any right at any time does not mean that right is waived. These terms represent the standard basis on which tree surgeons Tufnellpark provide services, and they are intended to be fair, practical and consistent with UK consumer and business law.
